These Terms of Service ("Terms") form a legally binding agreement between you and Bella Savoy LLC ("Creator," "we," or "us"), governing your use of our website at https://shop.bellasavoy.com, operated using the Fourthwall platform (the "Service").
By accessing or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms, including Creator's Privacy Policy. If you do not meet our eligibility requirements or do not agree to these Terms, you may not use the Service. Your continued use of the Service confirms your agreement to be bound by these Terms.
1. Service Overview
We offer a website where you can purchase merchandise that we make available for sale, including digital products and memberships ("Memberships," and together with all other merchandise, "Products").
2. Eligibility
You must be at least 13 years old to use the Service. By agreeing to these Terms, you represent and warrant that: (a) you are at least 13 years old; (b) you have not previously been suspended or removed from the Service; and (c) your registration and use of the Service complies with all applicable laws and regulations. If you are accepting these Terms on behalf of an entity or organization, you represent and warrant that you have the authority to bind that entity to these Terms, and you agree to be bound accordingly.
3. Accounts and Registration
To access any Membership, you must register for an account. When registering, you may be asked to provide certain information about yourself, such as your name, email address, or other contact details. You agree that this information is accurate and that you will keep it accurate and up to date at all times.
You will also be asked to create a password. You are solely responsible for maintaining the confidentiality of your account and password, and you accept responsibility for all activity that occurs under your account. If you believe your account is no longer secure, you must notify us immediately at contact@support.shop.bellasavoy.com.
4. General Payment Terms
Purchase of any Product through the Service may require payment of fees. Before any fees are charged, you will have the opportunity to review and accept them. All fees are listed in U.S. Dollars.
— Price
Bella Savoy LLC reserves the right to determine pricing for all Products and Memberships. We will make reasonable efforts to keep pricing information on the website current, and we encourage you to check periodically for updates. Creator may change the fees for any Product or Membership, provided advance notice is given before the change takes effect. Creator may, at its sole discretion, offer promotions with different features or pricing to select customers. Unless such an offer is made directly to you, it will not apply to your purchase or these Terms.
— Authorization
You authorize Creator and its third-party payment processors to charge the payment method on file for all Products you purchase and Memberships you subscribe to, including applicable taxes. If you pay by credit card, Creator or its payment processors may seek pre-authorization to confirm the card is valid and has sufficient funds or credit available.
— Memberships
Memberships may include automatically recurring payments. By activating a Membership, you authorize Creator or its third-party payment processors to charge all accrued fees on an ongoing basis until you cancel the Membership or we terminate it. The "Membership Billing Date" is the date you first purchase the Membership; your payment method will be charged automatically on this date each billing cycle for the upcoming period.
Your Membership will continue until canceled. To avoid being charged for the next billing period, you must cancel before the applicable Membership Billing Date. Charges will be applied to the payment method on file, or to an updated payment method if you change it. You may cancel your Membership at any time through the Billing tab in your account, or by contacting us at contact@support.shop.bellasavoy.com.
— Returns and Refunds
We accept returns of defective Products within 30 days of purchase ("Returns"). Approved Returns will receive a full refund, and we will cover return shipping costs where applicable. We do not accept returns or issue refunds for Products that are not defective. See our RETURNS & FAQ page for additional details.
— Shipping and Delivery. All Products purchased through the Service will be shipped according to the terms provided at the time of purchase to the shipping address you provide to us. You will be responsible for all shipping costs, which will be specified for you at checkout.
5. Website License
This section refers to your license to use our website — not to any Products you purchase.
As long as you follow these Terms, Creator gives you a limited license to use the Service and any Memberships you subscribe to, for personal, non-commercial use only.
This license is non-exclusive, cannot be transferred or shared with others, and can be revoked at any time. You may not copy, distribute, publicly share, or display the Service to others; make changes or modifications to it; or interfere with or bypass any of its features, including security measures. If applicable law prohibits you from using the Service, you may not use it.
6. Digital Product — Personal Use Only
Digital Products purchased through the Service are subject to separate license terms, which specify what you may and may not do with the file under the personal use license.
7. Feedback
If you provide input or suggestions about the Service or any Products, including proposed improvements ("Feedback"), you grant Creator an unrestricted, perpetual, irrevocable, non-exclusive, fully-paid, royalty-free right to use that Feedback for any purpose, including to improve the Service and create other products and services.
8. Ownership; Proprietary Rights
The Service is owned and operated by Creator. All visual interfaces, graphics, design, compilations, information, data, code, products, software, and other elements of the Service and Products ("Materials") are protected by intellectual property and other laws, and are the property of Creator or its third-party licensors. Except as expressly authorized by Creator, you may not use the Materials. Creator reserves all rights not expressly granted in these Terms.
9. Prohibited Conduct
By using the Service, you agree not to:
- Use the Service for any illegal purpose or in violation of any applicable law;
- Violate, or encourage others to violate, any third-party right, including intellectual property rights;
- Interfere with security features of the Service, including by disabling or bypassing content protections, or reverse engineering any part of the Service, except where expressly permitted by law;
- Interfere with the operation of the Service or other users' enjoyment of it, including by uploading malicious code, sending unsolicited offers to other users, collecting others' personal information without consent, or disrupting the network or servers used to provide the Service;
- Engage in fraudulent activity, including impersonating another person or entity, misrepresenting an affiliation, accessing another user's account without permission, or falsifying your age;
- Sell or transfer the access granted under these Terms, or any Materials, to another person; or
- Attempt, assist, or permit any of the above.
10. Modification of These Terms
We may update these Terms at any time. If you violate any provision of these Terms, your authorization to access the Service and these Terms automatically terminate. Creator or Fourthwall may also terminate these Terms or your account, or suspend or restrict your access to the Service, at any time, for any reason or no reason, with or without notice. You may terminate your account and these Terms at any time by contacting us at contact@support.shop.bellasavoy.com.
11. Effect of Termination
Upon termination of these Terms: (a) your license rights end immediately, and you must stop using the Service; (b) you will no longer be able to access your account or the Service; (c) you must pay any amounts owed prior to termination; and (d) all payment obligations accrued before termination, along with the sections governing licenses, ownership, indemnity, disclaimers, limitation of liability, and miscellaneous terms, will survive termination.
12. Modification of the Service
Creator may modify or discontinue the Service, in whole or in part, at any time, temporarily or permanently, without notice. Creator is not liable for any changes to the Service or for any suspension or termination of your access to it.
13. Indemnity
To the fullest extent permitted by law, you are responsible for your use of the Service. You agree to defend and indemnify Creator and its officers, directors, employees, consultants, affiliates, subsidiaries, agents, and Fourthwall (together, the "Creator Entities") against any third-party claim, and related liability, damage, loss, or expense (including reasonable attorneys' fees), arising from: (a) your unauthorized use or misuse of the Service; (b) your violation of these Terms or any applicable law; (c) your violation of any third-party right, including intellectual property, privacy, or confidentiality rights; or (d) any dispute between you and a third party. We may, at our own expense, take over the exclusive defense of any matter otherwise subject to your indemnification, and you agree to cooperate with our defense in that case.
14. Disclaimers; No Warranties
The Service and all Materials and content available through it are provided "as is" and "as available." Creator disclaims all warranties of any kind, whether express or implied, relating to the Service and its content, including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
No advice or information you obtain from the Service, the Creator Entities, or any Materials will create any warranty not expressly stated in these Terms. We are not responsible for any damage resulting from the Service or your interactions with other users. You use the Service at your own risk, and we are not responsible for any damage to your property (including your computer or mobile device) or any loss of data.
We provide the Service through Fourthwall, but these Terms and any purchase of Products are solely between you and Creator. Fourthwall is not a party to these Terms and has no liability for any damages or losses you incur from using the Service or purchasing Products.
15. Limitation of Liability
To the fullest extent permitted by law, in no event will the Creator Entities be liable to you for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from or related to your use of the Service, even if we have been advised of the possibility of such damages. In no event will the total liability of the Creator Entities for all claims relating to the Service exceed the amount you paid to Creator, if any, in the twelve months prior to the event giving rise to the claim. These limitations will apply even if any limited remedy fails of its essential purpose.
16. Miscellaneous
a. General Terms. These Terms, together with the Privacy Policy and any other agreements incorporated by reference, are the entire agreement between you and Creator regarding your use of the Service. You may not assign or transfer these Terms without our prior written consent; we may assign these Terms at any time without notice. Our failure to enforce any provision does not waive our right to enforce it later, and waiving one breach does not waive future breaches. Section headers are for convenience only and do not affect interpretation. Throughout these Terms, "including" means "including but not limited to." If any part of these Terms is found invalid or unenforceable, that part will be enforced to the greatest extent possible, and the rest will remain in effect.
b. Governing Law. These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. You and Creator agree to the exclusive jurisdiction of the state and federal courts located in San Francisco County, California, for any permitted lawsuit or proceeding.
c. Privacy Policy. Please review our Privacy Policy for details on how we collect, use, store, and disclose your personal information. Our Privacy Policy is incorporated into, and made part of, these Terms.
d. Additional Terms. Your use of the Service is subject to any additional terms, policies, or guidelines we post or link to (the "Additional Terms"), which are incorporated into these Terms.
e. Consent to Electronic Communications. By using the Service, you consent to receiving electronic communications from us, as described in our Privacy Policy. Any notices or disclosures we send electronically will satisfy any legal requirement that such communications be in writing.

h. No Support. We are not obligated to provide support for the Service. Where support is offered, it is subject to our published policies.
i. International Use. The Service is intended for use within the United States. We make no claim that it is appropriate or available for use elsewhere, and access from locations where use would be illegal is prohibited.
